ClaimPrep Terms of Service
These Terms of Service ("Terms") govern your access to and use of the website, software, WhatsApp intake flow, forms, video intake features, payment pages, reports, communications, and related services provided by Claimprep Technologies LLC ("ClaimPrep," "we," "us," or "our").
By accessing or using ClaimPrep, you agree to these Terms. If you do not agree, do not use the service.
1. About ClaimPrep
ClaimPrep is a property damage documentation software service.
ClaimPrep helps users collect, organize, structure, summarize, and generate property damage documentation reports based on information, photos, videos, documents, and other materials provided by the user.
ClaimPrep may provide digital tools for:
- damage intake;
- photo and video collection;
- document upload;
- receipt and invoice organization;
- timeline creation;
- report generation;
- AI-assisted summaries;
- WhatsApp-based intake;
- web-based intake;
- future video-based intake or video documentation features.
ClaimPrep is intended to help users organize documentation. It is not a substitute for professional legal, insurance, public adjusting, emergency, construction, engineering, remediation, or repair advice.
2. No Legal, Insurance, or Public Adjusting Services
ClaimPrep is not a law firm, attorney, insurance company, insurance broker, insurance agent, public adjuster, independent adjuster, contractor, engineer, remediation company, emergency response service, or government agency.
ClaimPrep does not:
- provide legal advice;
- provide insurance advice;
- provide public adjusting services;
- act as your representative before an insurance company;
- negotiate with any insurance company;
- settle or adjust insurance claims;
- determine insurance coverage;
- interpret insurance policies;
- calculate claim value;
- estimate repair costs;
- inspect property;
- verify the cause of damage;
- guarantee claim approval;
- guarantee payment from any insurer;
- submit claims on your behalf unless a future separate service expressly allows it and is legally permitted;
- communicate with insurers on your behalf unless expressly offered under a separate written agreement and legally permitted.
Any report created by ClaimPrep is based on information provided by the user and is for documentation and organization purposes only.
You should consult a licensed attorney, licensed public adjuster, licensed contractor, licensed engineer, emergency service provider, insurance professional, or other qualified professional when appropriate.
3. Emergency Disclaimer
ClaimPrep is not an emergency service.
If there is immediate danger, injury, fire, flooding, structural collapse, electrical hazard, gas leak, crime, mold hazard, or another urgent situation, contact emergency services or a qualified professional immediately.
Do not use ClaimPrep, WhatsApp, email, or video upload as a substitute for emergency assistance.
4. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use ClaimPrep.
By using ClaimPrep, you represent that:
- you are at least 18 years old;
- you have authority to submit information about the property;
- you have the right to upload the photos, videos, documents, and materials you provide;
- your use of ClaimPrep complies with applicable law.
If you use ClaimPrep on behalf of a company, property manager, landlord, contractor, association, or other organization, you represent that you have authority to bind that organization to these Terms.
5. User Responsibility
You are solely responsible for:
- providing accurate and complete information;
- reviewing all information before using or sharing any report;
- deciding whether to submit any report or information to an insurer or third party;
- complying with your insurance policy;
- meeting all claim deadlines and notice requirements;
- protecting your property from further damage;
- keeping copies of important documents;
- obtaining professional advice when needed;
- ensuring that uploaded photos, videos, and documents do not violate another person's rights;
- ensuring that you do not submit false, misleading, fraudulent, unlawful, or unauthorized information.
ClaimPrep does not verify the accuracy, completeness, cause, scope, value, or legal effect of information you submit.
6. User Content
"User Content" means any information, text, photos, videos, audio, documents, receipts, invoices, estimates, descriptions, messages, claim-related information, insurance-related information, property information, or other materials you submit to ClaimPrep.
You retain ownership of your User Content.
You grant ClaimPrep a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, organize, transform, summarize, extract, transmit, and generate reports from your User Content solely as needed to provide, operate, improve, secure, and support the service.
You represent and warrant that:
- you own or have permission to submit the User Content;
- your User Content is accurate to the best of your knowledge;
- your User Content does not violate law;
- your User Content does not infringe third-party rights;
- your User Content is not fraudulent, misleading, defamatory, unlawful, or harmful.
ClaimPrep may remove or refuse to process User Content if we believe it violates these Terms, applicable law, security rules, or third-party rights.
7. Photos, Videos, and Future Video Features
ClaimPrep may allow users to upload or record photos, videos, audio, screenshots, or other visual documentation.
Video features may include:
- video intake;
- video walkthroughs;
- damage documentation videos;
- video uploads;
- AI-assisted video summaries;
- extraction of still images or timestamps;
- organization of video evidence into a report.
By uploading or recording video, you agree that ClaimPrep may process the video to provide the service.
You are responsible for ensuring that videos do not include unnecessary private, sensitive, unlawful, or third-party information.
You should avoid recording:
- children;
- private individuals without permission;
- government IDs;
- passwords;
- full financial account numbers;
- full credit card numbers;
- unrelated medical information;
- unrelated personal documents;
- private spaces not relevant to the damage;
- anything you do not have permission to record or share.
ClaimPrep does not guarantee that uploaded photos or videos will prove damage, establish coverage, satisfy insurer requirements, or be accepted by any third party.
8. AI, Automation, OCR, and Report Generation
ClaimPrep may use artificial intelligence, automation, optical character recognition, image processing, video processing, document processing, and other software tools to provide the service.
These tools may help:
- organize information;
- summarize damage descriptions;
- extract text from documents;
- create timelines;
- identify uploaded materials;
- generate report drafts;
- structure final property damage documentation reports.
AI and automation may produce errors, omissions, incomplete summaries, inaccurate labels, or unsuitable wording.
You are responsible for reviewing all AI-assisted content, summaries, timelines, reports, and outputs before using, submitting, or sharing them.
ClaimPrep does not use AI to make legal determinations, insurance coverage decisions, claim approval decisions, public adjusting determinations, claim valuation decisions, or repair cost estimates.
9. Reports and Deliverables
ClaimPrep may generate digital reports or other deliverables based on information provided by the user.
Reports may include:
- property information;
- damage descriptions;
- photos;
- video references;
- timelines;
- receipts;
- invoices;
- mitigation steps;
- supporting documents;
- user-provided insurance-related information;
- AI-assisted summaries;
- user-submitted notes.
Reports are provided for documentation and organization purposes only.
ClaimPrep does not guarantee that:
- an insurer will accept the report;
- a claim will be approved;
- payment will be made;
- coverage exists;
- the report satisfies policy requirements;
- the report satisfies legal requirements;
- the report is complete;
- the report is free of errors;
- the report proves the cause, value, or scope of damage.
10. WhatsApp and Messaging
ClaimPrep may use WhatsApp, email, web forms, chat, or other communication channels for intake, support, and service delivery.
If you communicate with ClaimPrep through WhatsApp, your messages, phone number, media, metadata, and related information may be processed by WhatsApp/Meta according to their own terms and privacy practices.
By continuing through WhatsApp or other messaging channels, you consent to ClaimPrep processing your messages, photos, videos, documents, and related information to provide the service.
You should not send emergency information through WhatsApp.
11. Payments and Fees
You agree to pay all fees shown at checkout or otherwise agreed in writing.
ClaimPrep may offer:
- one-time report purchases;
- premium reports;
- video intake add-ons;
- subscription plans;
- business plans;
- partner plans;
- future premium features;
- other paid digital services.
Prices may change at any time. Price changes do not affect completed purchases unless otherwise stated.
Payments may be processed by third-party payment processors. ClaimPrep does not store full credit card numbers.
You are responsible for providing accurate billing information and for any taxes, fees, or charges applicable to your purchase.
12. Refund Policy
Because ClaimPrep provides digital, customized documentation services, payments are generally non-refundable once processing, intake, file review, video processing, document processing, or report generation has started.
ClaimPrep may approve refunds at its discretion if:
- duplicate payment occurred;
- payment was made in error;
- the purchased service was not delivered due to a technical failure caused by ClaimPrep;
- no processing had started;
- applicable law requires a refund.
Refund requests must be submitted to info@claimprep.pro within 7 days of purchase.
ClaimPrep does not provide refunds because:
- an insurer denies a claim;
- an insurer disagrees with the report;
- the user expected a different insurance outcome;
- the user submitted incomplete or inaccurate information;
- a third party refuses to accept the report;
- the user changes their mind after processing has started.
13. Subscriptions and Future Plans
ClaimPrep may offer subscriptions or recurring plans in the future.
If you purchase a subscription, you authorize recurring charges until you cancel according to the cancellation terms presented at the time of purchase.
Subscription terms, billing cycles, included features, cancellation rules, and renewal terms may vary by plan.
If future subscription terms conflict with these Terms, the specific subscription terms presented at checkout will control for that subscription.
14. Acceptable Use
You agree not to use ClaimPrep to:
- submit false, misleading, or fraudulent claims;
- commit insurance fraud;
- impersonate another person;
- upload content you do not have the right to use;
- violate privacy rights of others;
- upload malware, viruses, or harmful code;
- interfere with the service;
- reverse engineer, scrape, copy, or exploit the service;
- overload or attack the system;
- use automated bots without permission;
- violate any law or regulation;
- harass, threaten, abuse, or defame anyone;
- upload unlawful, obscene, exploitative, or harmful content;
- misrepresent ClaimPrep's role to an insurer or third party;
- claim that ClaimPrep is acting as your attorney, public adjuster, insurance representative, contractor, or adjuster.
ClaimPrep may suspend or terminate access if we believe these Terms have been violated.
15. Account Access and Security
If ClaimPrep provides account access, you are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity under your account.
You must notify ClaimPrep immediately if you suspect unauthorized access or misuse.
ClaimPrep is not responsible for losses caused by your failure to secure your account, device, email, phone, WhatsApp, or network.
16. Third-Party Services
ClaimPrep may rely on third-party services, including:
- hosting providers;
- payment processors;
- WhatsApp/Meta;
- email providers;
- analytics providers;
- advertising platforms;
- AI providers;
- OCR providers;
- video processing providers;
- cloud storage providers;
- PDF generation tools;
- security providers;
- customer support tools.
Third-party services may have their own terms, privacy policies, security practices, limitations, and availability.
ClaimPrep is not responsible for third-party outages, failures, errors, policies, or independent actions.
17. Privacy
Your use of ClaimPrep is also governed by our Privacy Policy.

18. Intellectual Property
ClaimPrep owns or licenses all rights in the website, software, workflows, templates, designs, branding, text, graphics, report structures, AI workflows, code, databases, processes, and related intellectual property.
You may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or create derivative works from ClaimPrep's service, templates, reports, software, branding, or content except as expressly allowed.
You may use the final report generated for you for your own documentation purposes.
ClaimPrep's name, logo, branding, and related marks may not be used without written permission.
19. Feedback
If you provide suggestions, ideas, feedback, comments, or improvement requests, you grant ClaimPrep the right to use them without restriction or compensation.
20. Service Availability
ClaimPrep may modify, suspend, limit, or discontinue any part of the service at any time.
We do not guarantee uninterrupted, error-free, secure, or continuous availability.
Features may change over time, including intake flows, report formats, AI features, video features, pricing, and supported channels.
21. Disclaimers
ClaimPrep provides the service on an "as is" and "as available" basis.
To the maximum extent permitted by law, ClaimPrep disclaims all warranties, express or implied, including warranties of:
- accuracy;
- completeness;
- reliability;
- merchantability;
- fitness for a particular purpose;
- non-infringement;
- uninterrupted operation;
- error-free operation;
- acceptance by insurers or third parties;
- claim approval;
- insurance recovery;
- coverage determination;
- legal compliance for your specific situation.
Some states do not allow certain warranty limitations. In those states, limitations apply only to the extent permitted by law.
22. Limitation of Liability
To the maximum extent permitted by law, ClaimPrep, its owners, officers, employees, contractors, vendors, service providers, and affiliates will not be liable for:
- indirect damages;
- incidental damages;
- consequential damages;
- special damages;
- exemplary damages;
- punitive damages;
- lost profits;
- lost business;
- lost data;
- insurance claim denial;
- reduced insurance payment;
- missed insurance deadlines;
- third-party decisions;
- user-submitted errors;
- AI-generated errors;
- video processing errors;
- service interruptions;
- unauthorized access caused by user-side security failures.
To the maximum extent permitted by law, ClaimPrep's total liability for any claim related to the service will not exceed the amount you paid to ClaimPrep for the specific service giving rise to the claim.
Some states do not allow certain limitations of liability. In those states, limitations apply only to the extent permitted by law.
23. Indemnification
You agree to defend, indemnify, and hold harmless ClaimPrep, its owners, officers, employees, contractors, vendors, service providers, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from:
- your use of ClaimPrep;
- your User Content;
- false, misleading, fraudulent, or unlawful information you submit;
- your violation of these Terms;
- your violation of law;
- your violation of third-party rights;
- your sharing of reports with third parties;
- your use of reports in an insurance claim or legal matter;
- your failure to obtain professional advice when needed.
24. Termination
ClaimPrep may suspend or terminate your access to the service if:
- you violate these Terms;
- you submit fraudulent or unlawful information;
- your use creates legal, security, operational, or reputational risk;
- payment fails;
- required by law;
- we discontinue the service.
Termination does not limit ClaimPrep's rights to retain records where permitted or required by law, including for tax, accounting, security, fraud prevention, dispute resolution, or legal purposes.
25. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
If you use ClaimPrep outside Florida, you are responsible for complying with your local state laws.
Nothing in these Terms limits rights that cannot be waived under applicable law.
26. Dispute Resolution
Before filing a legal claim, you agree to first contact ClaimPrep at info@claimprep.pro and attempt to resolve the dispute informally.
Your notice must include:
- your name;
- contact information;
- description of the dispute;
- the service or transaction involved;
- the result you are requesting.
ClaimPrep will attempt to respond within a reasonable time.
If the dispute cannot be resolved informally, either party may pursue available legal remedies subject to these Terms and applicable law.
27. Class Action Waiver
To the maximum extent permitted by law, you and ClaimPrep agree that disputes must be brought only on an individual basis and not as a plaintiff or class member in any class, consolidated, representative, or collective action.
If this waiver is found unenforceable, it will be limited or severed only to the extent required by law.
28. Changes to These Terms
ClaimPrep may update these Terms from time to time.
When we update the Terms, we will revise the "Last Updated" date.
Material changes may be communicated through the website, email, service notice, WhatsApp notice, or other reasonable means.
Your continued use of ClaimPrep after updated Terms become effective means you accept the updated Terms.
29. Severability
If any part of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
30. Entire Agreement
These Terms, together with the Privacy Policy and any checkout-specific terms, form the entire agreement between you and ClaimPrep regarding the service.
